Términos de Uso / Servicio XTREME AIRSOFT PUERTO RICO LLC

Bienvenido a XTREME AIRSOFT PUERTO RICO LLC. Estos Términos de Uso regulan el acceso, compra y uso de nuestros productos y servicios. Al realizar una compra o utilizar nuestros servicios, usted acepta quedar legalmente obligado por estos términos en su totalidad.

  1. Edad y responsabilidad Debe tener al menos 18 años de edad para adquirir productos de airsoft. Al realizar una compra, usted declara y garantiza que cumple con este requisito. Usted asume total responsabilidad por el uso, manejo y almacenamiento de los productos adquiridos, así como por cualquier consecuencia derivada de su uso indebido.

  2. Uso seguro de productos Los productos de airsoft deben ser utilizados de forma responsable y conforme a prácticas de seguridad aceptadas. Es obligatorio el uso de protección ocular y facial adecuada en todo momento. Nunca deben ser utilizados para amenazar, intimidar o causar daño. XTREME AIRSOFT PUERTO RICO LLC no será responsable por daños, lesiones o consecuencias derivadas del uso indebido, negligente o ilegal de sus productos.

  3. Cumplimiento legal El comprador es el único responsable de conocer y cumplir con todas las leyes y regulaciones aplicables, tanto locales como federales e internacionales.

  4. Indemnización Usted acepta indemnizar, defender y eximir de responsabilidad a XTREME AIRSOFT PUERTO RICO LLC, así como a sus afiliados, empleados y proveedores, de cualquier reclamación, daño o gasto (incluyendo honorarios legales razonables) que surja de: su incumplimiento de estos términos, el uso indebido de productos, o la violación de leyes o derechos de terceros.

  5. Devoluciones y política de ventas Todos los productos deben ser inspeccionados por el cliente al momento de su recepción. Los artículos utilizados no son elegibles para devolución. No se garantizan reembolsos en efectivo. Las devoluciones aprobadas podrán resolverse mediante crédito en tienda, sujeto a evaluación. Para más detalles, consulte la Política de Devolución y Reembolso, la cual forma parte integral de estos términos.

  6. Limitación de responsabilidad En la máxima medida permitida por ley, XTREME AIRSOFT PUERTO RICO LLC no será responsable por daños indirectos, incidentales o consecuentes; pérdida de uso, ingresos o beneficios; ni por daños derivados del mal uso o modificación de productos. Todos los productos se venden "tal cual".

  7. Derecho de denegar servicio Nos reservamos el derecho de rechazar o cancelar cualquier orden o servicio a nuestra sola discreción.

  8. Modificaciones Nos reservamos el derecho de modificar estos términos en cualquier momento, sin previo aviso. El uso continuo del servicio constituye aceptación de dichos cambios.

  9. Arbitraje y disputas (incluyendo chargebacks) Al utilizar nuestros servicios, usted acepta que toda disputa, reclamación o controversia relacionada con compras, transacciones, productos o servicios será resuelta exclusivamente mediante arbitraje vinculante, y no en tribunales, salvo que la ley aplicable disponga lo contrario. Antes de iniciar cualquier procedimiento externo, incluyendo disputas con bancos o procesadores de pago (chargebacks), el cliente se compromete a contactar directamente a XTREME AIRSOFT PUERTO RICO LLC y permitir una oportunidad razonable para resolver la situación. El cliente renuncia, en la medida permitida por ley, a participar en demandas colectivas (class actions) y a resolver disputas mediante jurado. El arbitraje se llevará a cabo en Puerto Rico, conforme a las leyes aplicables, y la decisión del árbitro será final y vinculante para ambas partes. XTREME AIRSOFT PUERTO RICO LLC se reserva el derecho de presentar evidencia y defender activamente cualquier disputa iniciada de manera externa.

  10. Aceptación de términos Al realizar una compra, usted confirma que ha leído, entendido y aceptado estos términos en su totalidad.

Welcome to XTREME AIRSOFT PUERTO RICO LLC. These Terms of Use govern the access, purchase, and use of our products and services. By making a purchase or using our services, you agree to be legally bound by these terms in their entirety.

  1. Age and Responsibility You must be at least 18 years of age to purchase airsoft products. By making a purchase, you represent and warrant that you meet this requirement. You assume full responsibility for the use, handling, and storage of purchased products, as well as any consequences arising from their misuse.

  2. Safe Use of Products Airsoft products must be used responsibly and in accordance with accepted safety practices. Proper eye and face protection is mandatory at all times. They must never be used to threaten, intimidate, or cause harm. XTREME AIRSOFT PUERTO RICO LLC shall not be liable for any damages, injuries, or consequences resulting from the improper, negligent, or illegal use of its products.

  3. Legal Compliance The buyer is solely responsible for knowing and complying with all applicable laws and regulations, whether local, federal, or international.

  4. Indemnification You agree to indemnify, defend, and hold harmless XTREME AIRSOFT PUERTO RICO LLC, as well as its affiliates, employees, and suppliers, from any claims, damages, or expenses (including reasonable legal fees) arising from: your breach of these terms, misuse of products, or violation of laws or third-party rights.

  5. Returns and Sales Policy All products must be inspected by the customer upon receipt. Used items are not eligible for return. Cash refunds are not guaranteed. Approved returns may be resolved through store credit, subject to evaluation. For further details, please refer to the Return and Refund Policy, which is an integral part of these terms.

  6. Limitation of Liability To the fullest extent permitted by law, XTREME AIRSOFT PUERTO RICO LLC shall not be liable for indirect, incidental, or consequential damages; loss of use, revenue, or profits; or damages resulting from misuse or modification of products. All products are sold "as is."

  7. Right to Refuse Service We reserve the right to refuse or cancel any order or service at our sole discretion.

  8. Modifications We reserve the right to modify these terms at any time without prior notice. Continued use of the service constitutes acceptance of such changes.

  9. Arbitration and Disputes (including chargebacks) By using our services, you agree that any dispute, claim, or controversy related to purchases, transactions, products, or services shall be resolved exclusively through binding arbitration, and not in court, unless otherwise required by applicable law. Before initiating any external proceeding, including disputes with banks or payment processors (chargebacks), the customer agrees to contact XTREME AIRSOFT PUERTO RICO LLC directly and allow a reasonable opportunity to resolve the matter. The customer waives, to the extent permitted by law, the right to participate in class action lawsuits and to resolve disputes by jury trial. Arbitration shall take place in Puerto Rico, in accordance with applicable laws, and the arbitrator's decision shall be final and binding on both parties. XTREME AIRSOFT PUERTO RICO LLC reserves the right to present evidence and actively defend any dispute initiated externally.
